Massachusetts Lawyers Weekly Interviews Atty. Eric D. Correira

Atty. Eric D. Correira was interviewed by Massachusetts Lawyers Weekly regarding a recent Massachusetts Superior Court decision where several individuals sued an attorney, his law firm, and his paralegal because the decedent’s new will in which they would have been included was not finalized before her passing. In Reilly, et al. v. Lane, Lane & Kelly, LLP, et al., the Court ruled that the would-be estate beneficiaries could not qualify as intended third-party beneficiaries of a testator’s contract for legal services with the drafting attorney, and even if they could, the plaintiffs did not allege sufficient facts to support a claim that the legal professionals breached their standard of care to their client.

From the article: “Swansea estate planning attorney Eric D. Correira said every lawyer practicing long enough in the field has experienced a fact pattern like the one in Reilly, in which a client simply does not finalize their wishes before they pass away. ‘It is reassuring for those in our practice area that the court immediately dismissed the lawsuit,’ he said.”
